Liability Waiver

Waiver of Liability, Assumption of Risks, and Indemnity Agreement

WAIVER: In consideration of my child or ward or spouse or me being permitted to participate in any way in any and all activities of Catholic Family Adventure Club (“CFAC”) at the residence of any Member or at any and all locations where such CFAC activities take place (collectively, the “Activities”), I, for myself, my spouse, my child and/or ward, my heirs, personal representatives or assigns, do hereby covenant not to sue, and release, waive, and discharge, CFAC, its directors, officers, staff members, volunteers, advisors, property owners, and/or agents, from liability and of and from any and all claims including the negligence or default of CFAC, its directors, officers, members, volunteers, advisors, property owners, and/or agents, resulting in personal injury, accidents or illnesses (including death), and property loss arising from, but not limited to, participation in the Activities.

ASSUMPTION OF RISKS: Participation in the Activities carries with it certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries. The specific risks vary from one activity to another, but the risks range from (1) minor injuries such as scratches, bruises, and sprains, (2) exposure to allergens or activities that may adversely affect medical conditions, (3) major injuries such as eye injury or loss of sight, joint or back injuries, broken bones or teeth, asthma or heart attacks, and concussions, to (4) catastrophic injuries including paralysis and death.

I have read the previous paragraphs and I know, understand, and appreciate these and other risks that are inherent in the Activities, which may include without limitation parties, picnics, BBQs, hiking, swimming, camping, field day, field trips, museums, plays, parks, recitals, parties, practices or other such activities. I hereby assert that my participation and/or the participation of my spouse, my children or wards is voluntary and that I knowingly assume and accept all risks. I also understand that I may participate in activities that are not sponsored or supported by CFAC but are private activities of Members and that I assume all risks associated with such private activities (“Non-CFAC Activities”).

INDEMNIFICATION AND HOLD HARMLESS: I also agree to INDEMNIFY AND HOLD CFAC, its directors, officers, members, volunteers, advisors, property owners, and/or agents, HARMLESS from any and all claims, actions, suits, procedures, costs, expenses, damages and liabilities, including attorneys’ fees, brought as a result of my involvement in the Activities or Non-CFAC Activities or both, and/or the involvement of my spouse, a minor child or ward of mine in the Activities or Non-CFAC Activities or both, in any location where Activities or Non-CFAC Activities or both are conducted, and of and from all claims which may hereafter develop or accrue to them on account of injury, loss or damage, which may be suffered by said minor or to any property, because of any matter, thing, or condition, negligence or default whatsoever, and to reimburse them for any such expenses incurred.

SEVERABILITY: The undersigned further expressly agrees that the foregoing waiver, and assumption of risks, indemnification and hold harmless, agreement is intended to be as broad and inclusive as is permitted by the law of the State of Texas, and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

ACKNOWLEDGMENT OF UNDERSTANDING: I have read this Waiver of Liability, Assumption of Risks, and Indemnity Agreement, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing this agreement freely and voluntarily, and intend by my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.

I further agree to accompany or have another adult accompany my minor child(ren) at all times while they are involved in any Activities on the premises of any Member, or at any other location, and acknowledge that I am fully and totally responsible for the above child(ren) at all times while he or she is participating in any CFAC Activities or at the homes of CFAC Members or at any other location.

Code of Conduct

Purpose

The purpose of the Code of Conduct is to unite our community under established expectations, allowing families with varying preferences to join together in Christian unity for support, socialization, and spiritual growth.

Expectations of Parents

1. Since we function as a community, parents are expected to contribute towards fulfilling the community’s mission. The Leadership Team will work with you to identify where you can contribute based on your season of life and unique spiritual gifts. All give what they can, and the Lord fills in the gaps.

2. At least one parent is required to be at any CFAC activity or event in which their child is participating, unless expressly approved by a member of the Leadership Team in advance.

3. An adult will never be alone with a child that is not their own (no matter their age.) Two adults must always be present if alone with a child.

4. Parents are expected to ensure they and their children treat others with respect and Christian charity. Destructive conversation, gossip, or other uncharitable speech or behavior against the Church, our community, and individuals is a direct violation of the code of conduct. Proselytizing against the Roman Catholic Church, her official teachings and the Magisterium is prohibited.

5. Members are not to post photos that include other children outside our secure community website without that parent’s permission. The only secure location to share photos of CFAC members is within the member portal.

Expectations of Children

1. As saints-in-training, children are to be kind. They are not permitted to bully, cross personal physical boundaries, or otherwise hinder their peers’ ability to feel safe and secure within our community. Children will seek help from adults if they are having trouble navigating differences.

2. Older children are expected to be accommodating towards younger children and set a good example by their actions, which allows our community to meld multiple ages and encourage a pro-life, pro-family mentality.

3. At events, children will follow the rules of both the facilities we use and CFAC Code of Conduct. They will be respectful of both natural and man-made environments.

4. Children will keep phones stowed away during events. They may use them before and after to arrange for transportation.

5. Children will not bring knives or other items that can be used as weapons to events or activities unless it is deemed appropriate to the event, such as a pocket knife brought on a camping trip. Fixed blade knives, bows, and airsoft guns are never permitted.

Expectations of Families

1. We must always leave the hosting facility in a better condition than that in which we found it. All members are expected to assist with cleaning up after an event or activity.

2. In addition to the CFAC Code of Conduct, we also follow the stated rules and all procedures of our hosting facilities. This includes, but is not limited to, parishes, public parks, field trip locations, etc. We will remain in the areas designated for our group at these locations.

3. As Temples of the Holy Spirit, we will dress in a way that glorifies God. When at CFAC events, we wear our CFAC shirts and reasonably respectful, age, and activity-appropriate clothing. Unless we are at a splash pad, pool, or similar, children older than toddlers are expected to wear a full set of clothing, including shirts and shoes, at all times.

4. RSVPs are required to participate in events and activities. RSVPs typically close 48 hours in advance of an event. It is expected that families adjust their RSVP if unable to attend, and families with active RSVPs who are ‘no-shows’ may be required to pay their share of an event where applicable.

5. Guests/future members are welcome with advance notice and approval from a Leadership Team member. It is expected that guests will have been notified of, and will adhere to, the CFAC Code of Conduct.

Dispute Resolution

It is in the organization’s best interest for parents to self-enforce these rules for the safety and comfort of all our families. If disagreements arise, the CFAC Leadership Team will assist in clarifying the expectations of CFAC families. Please be aware that the Board of Directors reserves the right to rescind membership for egregious or repeat issues, as well as modify or revise provisions at any time; these provisions will be made available to registered families.

Photo Waiver

We understand that use of photos presents a security concern for many families. Please note the following:

The majority of the photographs taken at our events are uploaded to the CFAC photo album which is only available to member families.
In accordance with our code of conduct, we DO NOT POST any child or adult photos on social media without explicit permission.
Names and other identifiying information will not be used without explicit permission.

The purpose of this photo waiver is to allow Catholic Family Adventure Club (CFAC), a nonprofit organization, permission to use images, videos, and recordings of our members for nonprofit, education, and promotional purposes, including but not limited to print publications, online publications, and the CFAC website. These materials will be owned by CFAC and used without compensation; furthermore, they can be edited, altered, or combined with other media at the discretion of the organization.

This will make you responsible for ensuring that your children do not appear in any group photos at events and you will need to adhere to the photo protocol as outlined by the Leadership Team (typically this means wearing a special bracelet at events so other families know not to take photos of your children.)

4. Once your registration is complete with CFAC, you will receive a discount code to get a new or renew your HSLDA Membership if you are not currently an active member.

However, if you are currently an active registered member with Homeschool Legal Defense Association, please provide your membership number so we can continue to offer opportunities to our community based on our members' participation in HSLDA. 7.
